Habeas corpus is a Latin phrase that means ”produce the body”.A person can seek a writ of habeas corpus from a judge demanding the court to determine whether their being lawfully held. The right to petition for a writ of habeas corpus cannot be constitutionally suspended. Currently, the Bush Administration is holding detainees captured in the War of Terror and has made the claim that because these individuals are military combatants they do not have this right.Yet, the Supreme Court recently ruled that all terror suspects have a right to seek this writ in US Federal Court.
