The right to petition for a writ of habeas corpus cannot be constitutionally suspended. Currently, the Bush Administration is holding detainees captured in the War of Terror and has made the claim that because these individuals are military combatants they do not have this right.Yet, the Supreme Court recently ruled that all terror suspects have a right to seek this writ in US Federal Court.
